Terms of Use

This web site is maintained  by Teach Democracy (formerly Constitutional Rights Foundation)  also refered to as “We”) as a service to a general audience. By using this site, you agree to comply with and be bound by the following terms and conditions of use. Please review these terms carefully. If you do not agree to these terms, you should not use this site.

1. Agreement
This Agreement (the “Agreement”) specifies the terms and conditions for access to and use of crf-usa.org (the “Site”) and describes the terms and conditions (“Terms”) applicable to your access of and use of the Site. This Agreement may be modified at any time by Teach Democracy. Any such modifications shall be effective immediately. You can view the most recent version of these terms at any time on our web site. Each use by you shall constitute and be deemed your unconditional acceptance of this Agreement.

2. Privacy
Your visit is also governed by our Privacy Policy. Please review our Privacy Policy.

3. Site Conduct and Use
When using the Site, you agree to abide by the following rules: (a) you may not post or transmit content (information, data, text, software, graphics, sound, photographs, video, messages, etc.) (“Content”) that is unlawful, harassing, libelous, defamatory, obscene, fraudulent, harmful, threatening, abusive, hateful, that violates the property rights of others (including without limitation infringing use of a copyright or trademark), that violates the privacy or publicity right of others, or are otherwise objectionable; (b) you may not interfere with other users’ use of the Site; (c) you may not use the Site to conduct any activity that is illegal or that violates the rights of others; (d) you may not use the site to advertise or sell products or services to others; (e) you may not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; (f) you may not post or transmit Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, confidential information, etc.); (g) you may not post Content to the Site unless the Content is freely owned by you or used with the permission of all other persons with any rights in the Content; and (h) you may not use the Site to collect or store personal data about other users.

We grant you a limited, revocable, nonexclusive license to use the Site solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy materials on the site. However, we hereby grant to all users of this site a license to reproduce all material contained herein for distribution to students, other school site personnel, and district administrators. All use of publications that you purchase through our online catalog at crf-usa.org is hereby governed by the copyright notices in each of those publications.

4. Ownership
All content on this Site, including, but not limited to, information, graphics, design, audio, video, interactive features, products, and services, is and shall continue to be the property of Teach Democracy or its content suppliers and is protected under applicable U.S. copyright, patent, and trademark laws, international conventions, and other relevant intellectual property and proprietary rights. Any copying, redistribution, use, or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this site.

5. Trademarks
All information on the Site, as well as the organization and layout of the Site, other than Content posted by you, is owned and copyrighted by Teach Democracy or its suppliers or other Site users. Except as expressly authorized by CRF, you may not copy, distribute, resell, display, sublicense or create derivative works based on any such information from the Site, in whole or in part. The Site contains various proprietary logos, service marks, trademarks, slogans, and product designations (collectively “Marks”). “Teach Democracy is  trademarked. All Marks, content, or other materials contained in this Site are protected as copyrights, trade dress, trademarks, and other intellectual properties owned by Teach Democracy or by other parties that have licensed their material to Teach Democracy. Teach Democracy’s trademarks may be used publicly only with written permission from Teach Democracy. No Teach Democracy trademark or service mark may be included in a hyperlink without Teach Democracy’s written permission. Any unauthorized use of the Marks or content of this Site may violate copyright, trademark, and other laws, in addition to being a material breach of the Terms of Use.

6. Removal of Content.
Teach Democracy reserves the right in its sole discretion to delete any Content submitted to or appearing on the Site. Forums, Comments, Teacher Stories, and other information-sharing locations on the Site may contain the opinions and views of other users. Teach Democracy is not responsible for the accuracy of any messages or postings on the Site. If you believe that any Content posted on the Site is infringing, defamatory, unlawful, threatening, libelous, obscene, or otherwise violates the letter or spirit of these Terms, please contact Teach Democracy immediately at crf@crf-usa.org.

7. Submission of Content.
If you submit Content to the Site, you grant Teach Democracy, or warrant that the owner of such Content has expressly granted to Teach Democracy, a world-wide, royalty-free, perpetual, irrevocable, transferable, non-exclusive, and fully sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Content (in whole or part) and to incorporate such Content in other works in any form, media, or technology now known or later developed.

8. Compliance With Laws
You agree to comply with all applicable laws regarding your use of this web site. You further agree that information provided by you is truthful and accurate to the best of your knowledge.

Teach Democracy provides academic, non-partisan programs and curricula that increase civic knowledge, skills, and dispositions using research-based methodologies including content about government and policy, student-directed discussion, and authentic civic engagement. Some state or local laws impose specific requirements on certain subject matters or manners of instruction, including those involving civic engagement or policy advocacy. It is the responsibility of teachers, administrators, and school districts to determine how, if at all, state and local laws may affect the use of Teach Democracy materials or resources. 

9. Indemnification
You agree to indemnify, defend, and hold Teach Democracy and our partners, employees, and affiliates, harmless from any liability, loss, claim, and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of this Site.

10. General Disclaimer
THE INFORMATION PROVIDED ON THIS SITE IS PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. THE CONSTITUTIONAL RIGHTS FOUNDATION DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THIS SITE.

11. Limitation of Liability
UNDER NO CIRCUMSTANCES WILL THE CONSTITUTIONAL RIGHTS FOUNDATION BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR USE OF THE SITE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR USE OF THE SITE.

You may have additional rights under certain laws (including consumer laws), which do not allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. 12. Use of Information
Teach Democracy reserves the right, and you authorize us, to use and assign all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy.

13. Copyrights and Copyright Agent
If you believe your work has been copied in a way that constitutes copyright infringement, please provide a notice containing all of the following information to our Copyright Agent:

(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
(b) A description of the copyrighted work that you claim has been infringed;
(c) A description of where the material that you claim is infringing is located on the Site;
(d) Your address, telephone number, and email address;
(e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
(f) A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

14. Applicable Law
You agree that the laws of the state of California, without regard to conflicts of laws provisions will govern these Terms of Use and any dispute that may arise between you and CRF or its affiliates.

15. Severability
If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

16. Termination
Teach Democracy may terminate this Agreement at any time, with or without notice, for any reason.
